Is a digitally signed lease valid? In the EU, an electronic signature cannot be refused legal effect just because it is electronic, so a lease signed online is not automatically invalid. Whether a simple electronic signature is enough for a particular lease, however, is decided by national law, and some leases or clauses require a stricter form. The answer therefore depends on the country, the type of property and the length of the lease.
This article covers the EU framework and, as worked examples, two jurisdictions: Germany and England and Wales. It does not cover other countries, such as the United States, or Scotland and Northern Ireland, which have their own rules. It is a general explanation, not legal advice. Before you rely on it for a real contract, check the law that governs your lease or ask a lawyer.
The EU framework in brief
The eIDAS Regulation (EU) No 910/2014 defines three levels of electronic signature: simple, advanced and qualified. Article 25 says an electronic signature shall not be denied legal effect or admissibility as evidence solely because it is electronic, and that a qualified electronic signature has the equivalent legal effect of a handwritten signature. At the same time, Article 2(3) leaves national and Union rules on concluding contracts and on form requirements untouched.
In practice: eIDAS tells you what each signature level is worth, and national law tells you which level a document needs. The three levels are explained in more detail in What Is an Electronic Signature? Simple, Advanced and Qualified.

Example 1: Germany
German law distinguishes between written form (Schriftform), which normally needs a handwritten signature, and text form (Textform), which is much lighter. Some useful points from the German Civil Code (BGB), checked on October 27, 2026 at gesetze-im-internet.de:
- Written form can be replaced electronically only with a qualified electronic signature. Section 126(3) allows the electronic form instead of written form unless the law says otherwise, and section 126a requires a qualified electronic signature for it. For a contract, both parties sign an identical document that way.
- Residential leases longer than one year. Under section 550, a lease for more than one year that is not concluded in written form is treated as concluded for an indefinite period, with notice possible at the earliest one year after the home was handed over. The lease does not become void; the fixed term is what is at risk.
- Leases of land and of premises that are not homes. Section 578 applies the same rule with text form instead of written form. Text form (section 126b) only requires a legible declaration that names the person making it, on a durable medium.
- Leases concluded for an indefinite period are not covered by the wording of section 550, which speaks of leases for more than one year.
- Notice of termination of a residential lease must be in written form under section 568(1). Signing the lease online does not change how it has to be terminated.
What follows from this, in general terms: an open-ended residential lease, or a commercial lease that only needs text form, can usually be concluded with a simple electronic signature. A residential lease whose fixed term of more than a year matters to you needs written form, which electronically means a qualified signature.
Example 2: England and Wales
The UK is not in the EU, so eIDAS is not the starting point here. Under section 7 of the Electronic Communications Act 2000, an electronic signature is admissible in evidence on the authenticity and integrity of a document. Whether a lease needs a particular form is again a separate question. Under the Law of Property Act 1925, section 52, a legal estate in land must generally be created by deed. Section 54(2) makes an exception for leases taking effect in possession for a term of not more than three years at the best rent reasonably obtainable without a premium; these can even be created orally.
So a typical short residential tenancy does not need a deed, and the deed formalities do not apply to it. A lease for more than three years has to be made by deed, which brings its own signing and witnessing rules. Check those, or ask a solicitor, before you sign such a lease electronically.

What makes an online signature hold up
Whatever the form requirement, a dispute is decided on evidence. A simple electronic signature is only as strong as the record around it:
- Who signed: the email address invited, and any extra check such as a code
- When: the time of opening and signing, with time zone
- From where: IP address and device
- What was signed: a fingerprint (hash) of the original and of the signed file, so any later change is visible
- An independent timestamp, so the signing time does not depend on one party's server
- Explicit consent to sign electronically
A signature backed by this record gives you far more to show in a dispute than a scanned signature pasted into a PDF.
A practical checklist before you send a lease online
- Which country's law governs the lease, and is it residential or commercial?
- Is it for a fixed term, and how long? Does any clause bind the parties for more than a year?
- Does that law require written form or a deed for this lease? If so, is a qualified signature or a deed process needed?
- Do any clauses or annexes, such as guarantees, need their own form?
- Will every party, including co-tenants and guarantors, sign the same final version?
- Where will the signed file and the signing record be kept for the whole term and beyond?
Signing leases with Document Sign
Document Sign is the signing app in the KIMISUITE workspace and works with simple electronic signatures under eIDAS. You upload the finished lease as a PDF, add the landlord and tenants as signers, place signature, initials, date and text fields, and send. With "Sign in order", the next signer is invited only after the previous one has signed. Recipients sign in the browser without an account, by drawing or typing, and the signing page and emails can be in their language.
The finished PDF is sealed, carries a stamp and document number on every page, and has a signing certificate attached with names, times, IP addresses, devices and the full history, plus an independent RFC 3161 timestamp. SHA-256 fingerprints of the original and the signed file are shown in the app. Learn more about signing documents online.
Where your lease needs a qualified signature or a deed, use a qualified trust service provider or the formal process that applies.
FAQ
Is a digitally signed lease legally binding?
In the EU, an electronic signature cannot be rejected only because it is electronic. Whether a simple signature is enough for your lease depends on national law and on the type and length of the lease.
Can I sign a rental agreement online in Germany?
Often yes, for example for open-ended residential leases or commercial leases that need text form. A residential lease for a fixed term of more than one year needs written form, electronically a qualified signature, or it is treated as open-ended.
Does a lease signed with a simple electronic signature become void?
In the German example above, no: a residential lease for more than a year without written form is treated as concluded for an indefinite period. Other countries have other consequences.
What should I keep after signing a lease online?
The signed PDF and its signing record with times, IP addresses, fingerprints and timestamp, for the whole term of the lease and afterwards.
